These Terms of Service ("Terms") apply to the VSLZR home visualizer, the contractor pages and dashboard at app.vslzr.app, and this website at vslzr.app (together, the "Service"). The Service is provided by Powered By Piland LLC, a North Carolina limited liability company, doing business as VSLZR ("VSLZR", "we", "us"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
What VSLZR is
VSLZR provides a visualizer for landscapers and other home-service contractors that lets homeowners preview their property with proposed work, such as landscaping or exterior lighting. Contractors place the visualizer on their own websites or use a page we host for them. A homeowner enters an address or uploads a photo, picks a style or service, and receives a rendering. Where the contractor has turned it on, the homeowner also sees an estimated price range and can send an inquiry to the contractor.
Who can use the Service
You must be at least 18 years old to use the Service. If you use the Service for a business, you confirm that you are allowed to accept these Terms for that business, and "you" includes that business.
Renderings and estimates
- Renderings are illustrations, not guarantees. A rendering is a computer-generated picture of an idea. Finished work will differ, and may differ a lot, depending on the property, materials, plants, weather, local rules and how the work is done. Do not rely on a rendering for measurements, property lines, structure or what is allowed on your property.
- Estimates are not offers. Any price range shown is a rough estimate based on automated measurements and pricing settings chosen by the contractor. It is not a quote, bid or binding offer from us or the contractor. The contractor sets the final price, usually after seeing the property.
- VSLZR does not do the work. We are not a contractor and are not a party to any agreement between a homeowner and a contractor. The contractor alone is responsible for their quotes, work, licensing, permits, insurance, warranties and customer service.
For homeowners and visitors
- Only enter an address, or upload a photo, of a property you own, live at, or are otherwise allowed to get work estimated for.
- Only upload photos you took or have the right to use. Try to avoid photos that show people, and never upload anything unlawful.
- When you submit your contact details, they are sent to the contractor whose website or page you used so that contractor can contact you about the work. How the contractor contacts you is up to the contractor and their own policies.
- Each design has a share link. Anyone with the link can view the rendering.
For contractors
Accounts
You can create a contractor account yourself at app.vslzr.app, or we can set one up for you. You are responsible for keeping your sign-in secure, for the people you invite to your account, and for activity under your account. Tell us right away at support@vslzr.app if you think your account has been used without permission.
Plans, credits and pricing
You can pay in one of these ways, at the prices shown on our pricing page or in a quote or checkout link we give you when you sign up or buy:
- Credits. One credit pays for one design, or for one completed estimate where your account uses estimates. Credits are bought in packs with no subscription.
- Monthly or annual plans. A plan includes a set number of designs or estimates each month. Anything you use beyond that is charged at the per-unit price for your plan.
All prices are in US dollars. If we give you a written quote, invoice or checkout link with different pricing, that controls for your account. Agencies and resellers buy under separate terms we agree with them.
Credits
- Credits in each pack expire 12 months after the date you bought that pack. We use the credits that expire soonest first.
- We will email the account owner before credits expire. Expired credits cannot be used or refunded.
- Credits are a prepaid right to use the Service, not money, a deposit or stored value. They have no cash value and cannot be transferred to another account or exchanged for money.
- We never charge inactivity fees or fees for holding a balance.
Plan allowances
Designs or estimates included in a plan are for that billing month only. Unused allowance does not carry over to the next month. Annual plans get their allowance month by month.
Billing and renewal
- Monthly plans are charged at the start of each month and renew automatically every month until you cancel.
- Annual plans are charged in full, up front, at the start of each year and renew automatically every year until you cancel.
- Before an annual plan renews, we email the account owner 15 to 30 days ahead with the renewal date, the amount, and how to cancel.
- We email a receipt for every charge. Each receipt shows the amount and a link to manage or cancel your plan.
- Usage beyond your plan's allowance is charged once a month to your saved payment method.
- If you turn on auto-reload, you authorize us to charge your saved card for the credit pack you choose each time your credit balance drops below the level you set. Before you turn it on, we show you the pack, its price in US dollars, the balance that triggers a charge, and the card we will use. We email a receipt each time it runs. You can change or turn off auto-reload at any time in your billing settings.
- You can set a monthly budget for automatic charges (auto-reload and usage beyond your plan). When the budget is reached, those charges stop until the next month.
- By adding a payment method, you authorize us to charge it for the plans, usage, credit packs and auto-reloads described here, in US dollars. If your card is replaced or updated by your bank, our payment provider, Stripe, may update the card details on file so your charges continue. Stripe processes all payments.
When credits, allowance or budget run out
When your account has no credits or allowance left, your budget is reached, or a payment has not gone through, new designs or estimates pause. Homeowners will see a form to contact you instead, and you will still receive those inquiries.
Failed payments
If a payment for your plan fails, we will email you and try the card again. You can also pay with another card from your billing page. Your plan keeps working for 7 days after the first failed payment. After that, plan designs or estimates pause until payment goes through. Credits you have already bought keep working.
Cancelling
You can cancel a plan at any time from the billing page in your account, or by emailing us. Cancelling stops the next renewal. Your plan keeps working until the end of the month or year you have already paid for. Monthly plans have no minimum term.
Refunds
Plan fees and credit packs are not refundable, including for partial months or years and for unused credits or allowance, except where the law requires a refund or we agree to one in writing. If we refund a credit pack, the unused credits from that pack are removed from your account. If we do not provide the Service as described in these Terms, we will refund what you paid for the affected period.
Price changes
We may change our prices. If a change affects a plan you already have, we will email the account owner at least 30 days before the new price applies to your next renewal, and the annual renewal reminder will also show the new price in bold. You can cancel before the change takes effect. Credits you have already bought keep their value.
Billing questions and disputes
If you think a charge is wrong, email us at support@vslzr.app within 60 days of the charge so we can look into it and fix any error. If you dispute a charge with your bank or card issuer instead of contacting us, we may pause automatic charges and new designs on your account until the dispute is resolved.
Taxes
Prices do not include taxes. If any taxes apply, they will be shown before you pay.
Your responsibilities
- Make sure the business details, pricing settings and service information you give us are accurate. Estimates shown to homeowners are based on your settings.
- You are responsible for how you use the inquiries you receive, including calls, texts and emails to homeowners. Contact rules for calls, texts and email vary by jurisdiction, and you are responsible for following the rules that apply to you.
- Keep a privacy notice on your own website that tells visitors you use the visualizer and may contact them.
- Do not present a rendering as a photo of completed work, or as a promise of how finished work will look.
- Keep homeowner information secure and use it only to respond to the homeowner and provide your services.
Your content
You keep ownership of your logo, brand assets and other content you give us. You give us permission to use that content to set up and run the Service for you. Between you and us, inquiries from homeowners who use your visualizer are yours to use under these Terms and the law.
Acceptable use
You agree not to:
- use the Service to break any law or anyone's rights, including privacy and intellectual property rights;
- upload anything unlawful, harmful, or that you do not have the right to share;
- use the Service to harass, track or profile people, or to look up properties for reasons unrelated to proposed work;
- scrape, overload, probe or interfere with the Service, or get around usage limits or bot protection;
- copy, resell or reverse engineer the Service, or use it to build a competing product.
We may limit, suspend or end access for anyone who breaks these Terms or puts the Service or others at risk.
Property imagery
When an address is entered instead of a photo, the Service retrieves publicly available street-level imagery of that property. That imagery, and any photo you upload, is used only as a reference to generate a new rendering. The original is not sent to contractors or shown on share pages, and we do not sell, license or redistribute it. Some imagery and map data come from Google and are subject to Google's own terms.
Use of renderings in our marketing
You give us a non-exclusive, royalty-free permission to use renderings made with the Service as examples on our website and in our marketing. We will not include the property address, house number, names or other personal information with them. A homeowner or contractor can ask us to stop using a specific rendering by emailingsupport@vslzr.app, and we will stop using it going forward. Copies already published or printed may take a reasonable time to remove.
Our property
The Service, including its software, design, and the VSLZR name and logo, belongs to us and our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service as described here and nothing more. If you send us feedback or ideas, we may use them without owing you anything.
Third-party services
The Service relies on outside providers, such as Google for maps, imagery and image generation, and may connect to tools you choose, such as your customer management system. We are not responsible for those services, and their own terms apply.
Service changes and availability
We may change, add or remove features, and the Service may sometimes be unavailable or slow. Rendering quality and measurement accuracy can vary. We will try to give contractors reasonable notice of changes that materially affect them.
Disclaimers
The Service, renderings and estimates are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise any particular number of inquiries, booked jobs or other business results.
Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, even if we were told they were possible. Our total liability for all claims relating to the Service is limited to the amounts you paid us for the Service in the billing period or under the quote or invoice the claim relates to, or, if you have not paid us anything, one hundred US dollars ($100). Some places do not allow certain limits, so some of these may not apply to you.
Indemnity
If you use the Service for a business, you agree to defend and cover us against claims, losses and costs (including reasonable attorney fees) arising from your work, your communications with homeowners, your content, or your breach of these Terms or the law.
Ending use
You can stop using the Service at any time. Contractors can cancel a plan or close their account as described under "Cancelling", subject to any commitment in a quote or invoice we agreed with them. We may suspend or end access as described above. Sections that by their nature should survive, such as disclaimers, limits of liability and governing law, continue after use ends.
Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law rules. Any dispute relating to these Terms or the Service will be resolved in the state or federal courts located in North Carolina, and you and we agree to the jurisdiction of those courts. There is no arbitration requirement. Before filing a claim, please email us so we can try to resolve it informally.
Changes to these Terms
We may update these Terms. We will change the "Last updated" date above, and if a change is significant we will take reasonable steps to let contractors know. Continuing to use the Service after an update means you accept it.
Other terms
If any part of these Terms cannot be enforced, the rest stays in effect. Not enforcing a part of these Terms is not a waiver. You may not transfer your rights under these Terms without our written consent. These Terms, the Privacy Policy and any written quote or invoice between us are the whole agreement about the Service.
